Wills
Whatever the value or nature of your assets, you have the right to decide who will manage your estate after your death, and how your assets will be divided. Without a will, the government will make these very important decisions for you and your family. In Ontario, the Estates Administration Act governs how people will be selected to manage and distribute the assets of your estate. Part II of the Succession Law Reform Act determines who is entitled to a share in your assets and in what proportion. This may not be the best result for your family’s specific needs and very likely will not reflect your intentions. Having a will allows you to have your assets distributed in a manner which is best for you. More specifically, it will allow you to prepare for the well-being of your family and makes sure that your estate will be managed by someone you trust.
Power of Attorney
A Power Of Attorney is a legal document, signed by you in front of two witnesses by which you authorize a person, or people, to make financial decisions on your behalf if you become incapable of acting for yourself due to an accident, illness or if you become mentally incapable.
There are two types of Power of Attorney. A Continuing Power of Attorney or a Power of Attorney for Property which deals with your personal possessions and finances, and a Power of Attorney for Personal Care which deals with your personal health care decisions such as consenting to medical treatments. The term "attorney" is in reference to the person you give the authority to and should not be confused with your lawyer.
